Love In Action’s Motion Denied But They Remain Encouraged
After the Tennessee Department of Mental Health ordered Love In Action International Incorporated to close their doors or obtain licensure, LIA sought a temporary injunction against the order. Their motion was denied yesterday.
But Love In Action isn’t giving up:
“We’re still very encouraged and we believe the court will eventually rule in our favor,” said Nathan Kellum, counsel for LIA. “There are no disputed facts, it’s just a question of the state misapplying the statute of licensure.”
The organization does not provide medication, Kellum said, and therefore should not be required licensure as a mental health facility. Patients who take prescription medication may continue to do so at LIA, but it is not regulated by staffers.
“All medication is kept in a central location for security reasons, but the workers do not dispense it at all,” Kellum said. “Patients have unfettered access to their prescriptions and they self-medicate.”
State officials also view the ruling as favorable, Potter said. The Attorney General will file for dismissal of the case on Monday.
