Dr. Christine Brody and Dr. Douglas Fenton have the right to refuse to artificially inseminate lesbians (or, rather, all women who aren’t married), ruled a California state appellate court on Friday. Brody and Fenton refused to artificially inseminate Guadalupe Benitez on grounds that performing the procedure violated their religious beliefs because Benitez was unmarried.

The court based their ruling on marital status discrimination not being prohibited by California law.
